These Terms of Service (“Terms”) govern your use of version 1.0 and later of the mobile application “Pongly” (“App”) provided by Pongly (“we”, “us”, or “our”). Please read these Terms carefully before downloading, installing, or using the App.

By using the App, you agree to be bound by these Terms.

1. Scope

These Terms apply to all relationships between us and users regarding the use of the App. The App is provided by an independent individual developer and is not affiliated with any prior or other table tennis related application.

2. License

We grant you a non-exclusive, non-transferable, revocable license to use the App for personal or non-commercial internal organizational use.

You may not:

Reverse engineer, decompile, disassemble, modify, or create derivative works of the App.
Reproduce, modify, or redistribute the App (except for personal backups permitted by the OS).
Incorporate the App into a commercial service without our consent.
Tamper with the App’s internal APIs, payment processing, or entitlement flags.

3. Functional Scope (v1.0)

Pongly v1.0 provides the following functional scope:

Creation of singles round-robin leagues
Player registration (photos optional)
Match score input (set counts) and automatic standings calculation
Match format selection (best of 1, 3, or 5 games)
ELO-based rating display, history, and progress chart
Tournament mode (auto-split leagues, up to 200 players, Pro feature)
Data export / import (CSV / PDF / JSON)
Multilingual support (Japanese, English, Simplified Chinese, Traditional Chinese)

Functionality may be expanded in future versions.

4. In-App Purchases (IAP)

4.1 Free Plan and Pro Upgrade

Free plan: Register up to 12 players. Create unlimited leagues. ELO personal rating, progress chart, CSV / PDF export, JSON backup, and other core features are included for free.
Pro upgrade (one-time purchase): Removes the player registration cap (unlimited) and unlocks tournament mode (auto-split leagues, up to 200 players). The Pro upgrade is NOT a subscription.
Reference prices (vary by region and tax): JP ¥980 / US $6.99 / CN ¥35 / TW NT$200 / HK HK$50. The final price displayed at purchase time prevails.

4.2 Payment

In-app purchases are processed by Apple App Store or Google Play.
Prices vary by region, currency, and applicable taxes. The price shown at the time of purchase is the final price.
For payment issues (failed transactions, duplicate charges, etc.), please first contact the relevant store.

4.3 Restore Purchases

A “Restore Purchases” feature is always available in the App’s settings screen, allowing you to restore your purchase on another device that uses the same Apple ID or Google account.
Purchases cannot be transferred across stores (e.g., Apple to Google).

4.4 Refunds

The App uses a one-time purchase model. Due to the nature of digital content, we generally do not issue direct refunds.
Refund requests must be made via Apple App Store or Google Play under their respective policies (each store decides on a case-by-case basis).
Where mandatory consumer protection laws (such as Japan’s Consumer Contract Act) require refunds, those laws prevail.

4.5 Price Changes

We may change the price of the Pro upgrade in the future. Price changes apply to new purchases only and do not affect users who have already purchased.

4.6 No External Payment Links

In accordance with Apple’s and Google’s policies, the App does not present external payment links or external purchase paths other than the store-standard IAP.

5. Data Management

All data created or entered in the App is stored only on your device.
For backup or device migration, please use the App’s export / import features.
We are not liable for data loss. Please make regular backups at your own responsibility.

6. Intellectual Property

All intellectual property rights in the App and its contents (icons, logo, UI, code, text, color palette, etc.) belong to us or the respective rights holders.
Content you enter into the App (player names, etc.) belongs to you or your organization.
“Pongly” is our trademark or pending trademark.

7. Prohibited Conduct

You may not:

Use the App in violation of law or public order.
Infringe on intellectual property, privacy, or other rights of us or third parties.
Interfere with the operation of the App.
Fraudulently acquire or use IAP entitlements (e.g., bypassing payment on jailbroken devices, automation tools).
Resell or redistribute information obtained through the App.

8. Disclaimer

The App is provided “AS IS”. We make no warranties, express or implied, about its accuracy, completeness, or fitness for a particular purpose.
The ELO-based rating provided by the App is intended for entertainment and reference purposes and has NO relationship with the official rankings of any table tennis governing body (ITTF, JTTA, etc.). We do not warrant the accuracy of the rating values or their correlation with competitive playing strength.
We are not liable for any damages arising from use or inability to use the App, except where caused by our willful misconduct or gross negligence.
Where mandatory consumer protection laws apply, those laws take precedence.

9. Support

Support is provided via email on a reasonable-efforts basis (see §12). We do not guarantee response time or scope.

10. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via in-app notice or our official website.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan.
Any dispute arising from the App shall be subject to the exclusive jurisdiction of the district court in our place of business as the court of first instance.
If you are a consumer, the mandatory consumer protection laws of your jurisdiction take precedence.
For users within the EU, mandatory rules may cause the consumer laws of your country of residence to apply.
